“I share with you that on February 11 I received my NB birth certificate. I will tell you a little about what the process was like,” Fausto shared through social networks.

According to what Fausto revealed, his fight to obtain his birth certificate began on September 24, 2023, when he decided to go to the National Electoral Institute (INE) with the purpose of having the electoral authority issue him a credential specifying that he was a non-binary person, something that the INE refused to do since it supposedly did not have the powers to do so.

The INE's refusal, as explained by Fausto, was due to the fact that the credentials they issue are limited to placing the data found in the birth certificates. Therefore, in order to obtain a credential that recognizes the person as non-binary, it would be necessary for the gender identity to be expressed in the record.

Due to the above, Fausto decided to turn to the organization Amicus DH, which is headed by Juan Pablo Delgado, with the purpose of obtaining advice to request the Civil Registry of Guanajuato to issue a birth certificate recognizing him as a non-binary person; However, despite the attempt, the request was rejected and that was when in November 2021 Amicus DHthe Trans Youth Network and Hive 41 They supported Fausto and managed to obtain protection.

By January 2022, the Fourth District Judge based in León Guanajuato was unable to confirm the refusal, so the Civil Registry could no longer refuse to issue his new birth certificate.
