Magistrate Fredy Orellana, head of a criminal court in Guatemala, ordered the Public Ministry (MP) to open an investigation against the head of the Citizens Registry (RC) of the Supreme Electoral Tribunal (TSE), Ramiro Muñoz for allegedly disobeying a resolution issued by first.

Orellana pointed out that Muñoz failed to comply with the suspension of the legal status of the political party Movimiento Semilla.

Due to the position held by the defendant, he has the right to pre-trial, so if applied, the Public Ministry will have to request the Supreme Court of Justice (CSJ) that the immunity he possesses be withdrawn.

Last Wednesday, Orellana ordered Muñoz to suspend Semilla's legal status within 24 hours, so that no popular election position could be awarded to its candidates either.

Given this, Semilla went before the Constitutional Court (CC) and requested an amparo against the Supreme Electoral Tribunal, so as not to run the risk that Orellana's resolution would be accepted. However, the CC described Orellana's order as illegal.

Then, the Constitutional Court ruled in favor of the party and ordered that the results of the presidential elections be made official and proceed to the ballot where Semilla's presidential candidate will be presented.
