Represented by Judge CĂ©sar San MartĂn, the Peruvian justice decided to declare unfounded the appeal that "proposed nullity or annulment of the constitutional complaint formulated by the Prosecutor's Office as proceedings for criminal organization, aggravated influence peddling and aggravated collusion in the investigation against Castillo Terrones ".
"No constitutional provision or legal precept was infringed, nor were the rights of the challenger. His appeal must be dismissed," San MartĂn estimated in his resolution.

In this sense, the judicial authority explained that "the aforementioned provision of the National Prosecutor's Office, when ordering preliminary proceedings against the President of the Republic, did not infringe articles 99, 100 and 117 of the Constitution."
After rejecting an appeal filed by the defense, the Peruvian Supreme Court also ratified on March 31 the decision to impose some 36 months of preventive detention against Pedro Castillo, while he is the subject of the investigation for corruption.
For this alleged crime, Castillo is accused of having headed a criminal organization dedicated to obtaining money in exchange for fraudulent public works tenders. The deposed president has asserted "today, more than ever, I emphatically reject the fact that I have never led or been part of a criminal network, I have never been an accomplice to a crime without a perpetrator."
To this accusation was added another of 18 months for the alleged crime of rebellion during his attempt to dissolve Congress and establish an emergency government on December 7.
