Brazilian court suspends part of the decree on caverns | News

The minister of the Superior Court of Justice (STF, for its acronym in Portuguese) of Brazil, Ricardo Lewandowski, suspended this Monday part of a decree that President Jair Bolsonaro had presented, which authorized construction in areas of underground cavities.

The decision considers the risk of irreversible damage to underground natural cavities and their areas of influence, said the press release presented by the Superior Court.

Judge Lewandowski specified that the presidential norm "imprinted a real setback in environmental legislation by allowing -under a cloak of apparent legality- that negative impacts, of an irreversible nature, affect heritage caverns".



"Its provisions, with all evidence, threaten natural areas that are still virgin by suppressing the protection that existed until now, otherwise constitutionally guaranteed," the magistrate remarked.

Despite this measure, the suspension issued by Lewandowski will now have to be analyzed by the full high court, made up of 11 judges, on a date that has not yet been determined.



On January 12, the Brazilian head of state presented a decree that authorized the destruction of any type of cave for the construction of projects considered to be of public utility to favor even mining companies in the country.
