Amparo to the UNAM does not impact Yasmín Esquivel: the minister's lawyer

The defense of the minister of the Supreme Court of Justiceto of the Nation (SCJN) Yasmín Esquivel Mossa, assured that the protection granted to the National Autonomous University of Mexico (UNAM) does not impact the case of alleged thesis plagiarism degree in which your client has been identified.

Lawyer Alejandro Romano Rascón reported that The federal judge's ruling only declares an agreement by Civil Judge 60 illegal. in Mexico City, which was issued after the precautionary measures that protect the minister so that the UNAM does not rule on the issue.

“This agreement of the local judge, challenged by the UNAM via amparo, only declared the finality of the precautionary measures, because the University itself did not appeal them in a timely manner in the local trial.”

“In his amparo ruling, the judge Fourth District in Civil Matters of Mexico City granted protection to the UNAM considering that in local civil trials, precautionary measures cannot be declared final; and, as a consequence, this must be agreed in the local file.”

“The District Judge never addressed whether or not the precautionary measures issued by the local judge were correct, since such measures were never questioned by the UNAM,” stated the litigant.

This means that The minister will continue with civil precautionary measuresand the University will not be able to issue any resolution against him until the trial is finally decided.

“The above without prejudice to filing the appeal that the Law grants against the sentence handed down by the aforementioned Fourth District Judge in Civil Matters of Mexico City”.

He pointed out that UNAM also did not challenge the other civil ruling where a local judge recognized Minister Yasmín Esquivel Mossa as the sole author of her bachelor's thesis, so this determination has caused a situation.
